Announcement of the launch of the selection process for the members of the Financing and Risk Committee of the ODA Public Institution
NOTICE
on launching the process of selecting the members of the Financing and Risk Committee of the ODA Public Institution
The Public Institution Enterprise Development Organisation (hereinafter – ODA) announces the launch of the process of selecting members of the Financing and Risk Committee of ODA, for a mandate of 4/patru/years. Committee of financing and risk of ODA shall be constituted under Section 3 of the ODA Statutes, approved by Annex 1 on Government Decision No 487/2022.
Requirements for candidates:
1) Holds the citizenship of the Republic of Moldova or is a person holding the citizenship of another state or a stateless person domiciled in the territory of the Republic of Moldova;
2) Has a higher education qualification (at least bachelor’s degree) in economics, law or some science (physics, mathematics, engineering, computing);
3) Knowledge of Romanian (written and spoken);
4) Has full capacity to act;
5) The absence of a criminal record, the absence of criminal prosecution, the absence of the status of defendant and the absence of evidence that the person has been responsible for economic crimes, tax evasion and scams over the last five years;
6) Lthe prohibition on taking up certain management functions and/or functions relating to economic and financial activity;
7) Has in the last ten years at least three years experience in the field of economic-financial law and/or economic law and/or financial law;
8) Is not a politically exposed person;
9) is/is not independent from ODA, management and/or its founders. By way of exception, the ODA Council may also decide on the admission to the selection of persons who do not satisfy the requirement of independence, but may appoint as a member of the Committee only one person who does not satisfy the requirement.
Note the person who will be considered to be independent will be: does not have/did not have any current or past relationship or relationship of any kind with the ODA or its management (the Council and the Director) that would influence the member’s objective and balanced judgement and reduce its ability to make independent decisions, and that meets the following requirements:
1) is not a member of the management body of ODA, funders and has not held such a position for the past five years;
2) is not an employee of the founder, ODA, funders and would not have had such an employment relationship in the last five years;
3) does not have and has not had in the last year any economic relationship with ODA, whether personally or as a shareholder, associate, member of management bodies, employee of a legal person that has or has had in the last year such economic relationship with ODA, if the substantial character (more than 1 % of the equity value) of the economic transactions is such as to impair its objectivity;
4) is not, and has not been within the last two years, an auditor of the ODA or a shareholder/associate of the audit entity that is carrying out or has carried out the audit of the ODA financial statements;
5) has not been a member of the Committee for more than two terms;
6) is not a linked person to the members of the management bodies of the ODA. The affiliation relationship shall be determined in accordance with Article 203(2) of the Civil Code of the Republic of Moldova No 1107/2002.
A natural person who in the last year performs or has performed prominent public functions at national level (natural persons who hold or have held the positions of head of state, government and cabinets of ministers, members of government, deputy ministers, heads of state chancelleries, members of parliament, leading members of political parties, judges of supreme courts of justice, also members of courts of auditors and of the board of national banks, officers with higher and supreme military ranks, members of the governing and administrative bodies of state-owned enterprises, members of the royal families, ambassadors and senior staff of diplomatic missions, directors, vice-directors and members of management boards of international organisations) and/or internationally (natural persons who have held or hold prominent public dignities in accordance with the law, such members of the governing and administrative bodies of state-owned enterprises, municipal enterprises, as well as commercial companies with majority state capital, political party leaders and officers with higher and supreme military ranks), as members of the governing bodies of political parties will be considered politically exposed.
In order to apply for the selection procedure, candidates will submit their request to participate and a file, which will include the following documents:
1) A copy of the identity document/residence permit, together with the contact address, contact telephone number and email address at which the notifications delivered will be deemed to have been received;
2) Copies of higher education diplomas and, where appropriate, postdoctoral degrees;
3) Copies of other documents proving that specialisations or training have been carried out, if such documents are available to the candidate;
4) Copy of the document certifying the change of name (if applicable, if the current name does not correspond to that of the study documents submitted);
5) Documents or copies thereof proving the candidate’s work experience in accordance with the relevant requirements;
6) The sworn statement that the person is not being prosecuted, is not a defendant, has no criminal record, there is no evidence that he/she has been responsible for economic crimes, tax evasion and scams in the last five years;
7) Declaration on honour concerning the absence of prohibition on taking up certain posts management and/or related to economic and financial activity;
8) Declaration on honour that it is not politically exposed person;
9) The declaration on honour as to whether or not he or she is independent from ODA as required for participation in the selection;
10) Curriculum Vitae;
11) Letter of personal motivation to become a member of the Finance and Risk Committee (up to 1 page, text size 12, character Times New Roman, range 1,5);
12) Own vision of priority directions to support entrepreneurship in the Republic of Moldova for the next 4 years (up to 2 pages, text size 12, character Times New Roman, range 1,5).
Note In order to develop their vision, applicants shall be entitled to request from ODA the submission of information on the total annual budget of the entrepreneurship support fund over the last three years. The information is to be submitted within three working days of the request.
If requested, the candidate shall submit a criminal record attesting to the absence of any criminal records and the originals of the documents.
